Salamanca Dental is committed to providing you with the best possible customer service experience. Salamanca Dental is bound by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles, which set out a number of principles concerning the privacy of individuals. This privacy policy explains how Salamanca Dental complies with those principles. Salamanca Dental has additional obligations relating to your personal information under the Health Practitioner Regulation National Law. This policy applies in addition to those obligations. Collection of your personal information

Salamanca Dental collects personal information about you in the course of providing services to you. We will collect this information from forms you complete, discussions we have with you and otherwise in the course of services we provide to you. We may also collect information from other healthcare providers with your consent or from publicly available sources and third parties.

If we collect personal information about you from a third party we will, where appropriate, request that the third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to gain access to and correct and update the information.

When collecting and maintaining records from patients we comply with the guidelines on dental records issued by the Dental Board of Australia.

Types of personal information we collect

The type of personal information we may collect can include (but is not limited to), your name, postal address, email address, phone numbers, billing information, health insurance information and, if applicable, employment information.

We may also collect and hold sensitive information about you, including health information. We only collect sensitive information about you with your consent, or otherwise in accordance with the Privacy Act.

Where you do not wish to provide us with your personal information, we may not be able to provide you with requested goods or services.

Sharing of your personal information

We may occasionally hire other entities to provide services on our behalf, including but not limited to handling customer support enquiries, processing transactions or shipping goods. Those companies will be permitted to obtain only the personal information they need to deliver the service. Salamanca Dental takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

We may also be required to give your personal information to insurers, health regulatory agencies and other health providers. We will only do this with your consent or where required or authorised by law.

Your personal information may be disclosed to our service providers or professional advisors where necessary for our activities, for example to consultants, IT service providers, accountants, auditors or our insurers.

Use of your personal information

We will only use your personal information for purposes that would be considered relevant and reasonable in the circumstances.

  2. manage and administer those goods and services, including account keeping procedures;

We may disclose personal information to third parties such as our suppliers, organisations that provide us with technical and support services, or our professional advisors, where permitted by the Privacy Act. If we disclose information to a third party, we generally require that the third party protect your information to the same extent that we do.

We will not use or disclose your personal information for any other purpose unless you have consented to that use or disclosure, or the relevant use or disclosure is otherwise permitted by the APPs or some other law.

Securing your personal information

We take reasonable steps to store your personal information securely. We keep records electronically and on paper. We maintain appropriate physical, procedural and technical security for our offices and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of personal information. We take reasonable steps to ensure the personal information we hold, use and disclose is up-to-date, complete, relevant and not misleading.

We destroy or de-identify information that we no longer reasonably require for our purposes or required to be kept by law. Dental records may need to be retained for up to 10 years from the date of last contact.

Direct Marketing

Like most businesses, marketing is important to our continued success. We may provide you with information about new products, services and promotions either from us, or from third parties which may be of interest to you, including letting you know it is time for a regular checkup.

Provided that you have not unsubscribed or otherwise opted out, we may use your information for direct marketing:

  1. where you have agreed to receive direct marketing from us; or
  2. where you have engaged with us directly, and we believe that you would reasonably expect to receive direct marketing from us.

We may utilise the services of third parties to assist us with undertaking our direct marketing activities. We will not otherwise disclose your personal information to third parties for marketing purposes without your consent.

You may opt out at any time if you no longer wish to receive commercial messages from us. You can make this request by contacting our Privacy Officer.

Note that if you opt-out of direct marketing messages from us, we may still communicate with you from time to time for other purposes, including where we:

  1. respond to any correspondence you send us;
  2. provide you with invoices or updates in respect of any orders you have placed with us;
  3. engage with our contractors and suppliers; or
  4. are legally required to provide you with notice of certain matters.

Cookies

A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time. We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing the Website. Overseas transfers of personal information

We disclose your personal information to our suppliers, such as Ormco which is located in the United States of America.

As at the date of this Privacy Policy, we are not likely to disclose personal information to other overseas recipients. If in future we do propose to disclose personal information overseas, we will do so in compliance with the requirements of the Privacy Act. We will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.

If you do not want us to disclose your information to overseas recipients, please let us know.

Personal information about employees

We may collect personal information about our employees and prospective employees, as part of their application and during the course of their employment, either from them or in some cases from third parties such as recruitment agencies.

This may include information about the employee’s health, their right to work in Australia, or other sensitive information. For some roles, employees may need to obtain a security clearance or provide a criminal history search.

Under the Privacy Act, personal information about our current or former employees may be held, used or disclosed by us in any way that is directly connected to the employment relationship. We handle information about our employees in accordance with legal requirements and our applicable policies in force from time to time.

Changes to this privacy policy

Salamanca Dental reserves the right to make amendments to this privacy policy at any time. You should regularly check the Website to ensure you are aware of any changes.

Accessing and updating your personal information

You have a right to access or request that we correct your personal information, subject to exceptions allowed by law. If you would like to do so, please contact us. You may be required to put your request in writing and we may need to verify your identity before proceeding.

If we refuse your request for any reason we will give you written notice as to the reasons for refusing that request. In any case we will respond within a reasonable time. We are not obliged to correct any of your personal information if we do not agree that it requires correction and may refuse to do so.

Salamanca Dental reserves the right to charge a reasonable fee for searching for, and providing access to, your information. However, there is no fee to make a request and we will discuss that fee before proceeding to give you access.
